Please read carefully. Protect Our Family is a safety-assistance tool, not an emergency service. It does not replace 911 or professional emergency responders, and it cannot guarantee that any alert, message, or location update will be delivered or delivered on time. These Terms explain what the App does, what it does not do, and the responsibilities you accept when you use it.

 

1. Acceptance of These Terms

These Terms and Conditions (“Terms”) form a binding agreement between you and Protect Our Family, Inc (“the Company,” “we,” “us,” or “our”) governing your use of the Protect Our Family mobile application and related services (collectively, the “App”). By creating an account, accessing, or using the App, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the App.

2. Who May Use the App

You must be at least 18 years old and legally able to enter into a contract to create an account. The App is operated by adult account holders who manage the safety of the members of their household. Children do not create or log into accounts. By adding another person (including a minor) to your household, you represent and warrant that you have the legal authority to provide their information and to receive safety information about them, and that you have obtained any consent required by law from that person or their parent or guardian.

3. What the App Does

The App provides family-safety tools that may include, depending on your plan and settings:

·       Live location sharing and location history among household members;

·       Geofences and place-based arrival and departure alerts;

·       Scheduled check-ins and arrival (“no-show”) alerts;

·       Emergency broadcasts to the contacts you designate;

·       Missing-person reporting tools, posters, and law-enforcement information packets;

·       Storage of member profile details, emergency contacts, and health and identification information you choose to enter.

4. What the App Is NOT — Important Safety Disclaimer

The App is not an emergency response service and is not a substitute for calling 911 or contacting professional emergency services, medical providers, or law enforcement directly. In any emergency, contact 911 or your local emergency number first.

The App depends on factors outside our control — including your device, its battery and settings, GPS/location accuracy, mobile carrier and internet availability, third-party messaging providers, and the availability of the recipients you designate. For these reasons we cannot and do not guarantee that any location update, notification, SMS, email, check-in, or emergency broadcast will be sent, received, accurate, or timely. You should not rely on the App as your sole means of safety or communication.

5. Your Responsibilities

·       Provide accurate information and keep your account details, emergency contacts, and member information current.

·       Obtain any legally required consent before adding a person’s information or tracking their location.

·       Keep your login credentials confidential; you are responsible for activity under your account.

·       Configure device permissions (location, notifications) as needed for the features you want to use.

·       Use the App only for lawful, personal family-safety purposes.

6. Acceptable Use

You agree not to:

·       Use the App to stalk, harass, surveil, or harm any person, or to track anyone without lawful authority and any required consent;

·       Submit false, misleading, or fraudulent information, including false missing-person or emergency reports;

·       Violate any law or the rights of others, including privacy and publicity rights;

·       Interfere with, disrupt, reverse engineer, or attempt to gain unauthorized access to the App or its systems;

·       Resell, sublicense, or commercially exploit the App without our written permission.

Misuse of safety and emergency features — including knowingly filing a false report or sending a false emergency broadcast — may be unlawful and may result in immediate termination and referral to authorities.

7. Health, Medical, and Identification Information

The App lets you store health-related details (such as medications, blood type, and medical conditions) and identification details for safety purposes. This information is provided by you for your own reference and to assist responders you choose to share it with. It is not medical advice, and we do not verify its accuracy. Always consult qualified professionals for medical decisions.

8. Missing-Person and Law-Enforcement Tools

The App can generate missing-person posters and information packets and can transmit information you provide to recipients you select. You are solely responsible for the accuracy of the information you submit and for using these tools appropriately and lawfully. We do not act as, and are not a substitute for, law enforcement or a professional search organization.

9. Your Grant of Rights to Use Photos, Likeness, and Descriptors for Safety Purposes

When you create a member profile and when you use the missing-person, poster, community-alert, or law-enforcement features of the App, you grant the Company — and the law-enforcement agencies and official missing-person partners you authorize through the App (such as the National Center for Missing & Exploited Children) — a worldwide, royalty-free, non-exclusive license and permission to reproduce, publish, distribute, display, transmit, translate, and create safety materials from the information contained in the affected profile and report. This includes photographs, physical and medical descriptors, identifying details, and last-seen location, for the purposes of locating, identifying, and safeguarding the member and producing missing-person posters, public community alerts, and law-enforcement information. This permission remains in effect for as long as reasonably needed to carry out a safety or missing-person effort.

You represent and warrant that you have the legal authority to grant this permission for yourself and for every member in your household — including any minor or any adult for whom you are the legal guardian or authorized representative — and that granting it does not violate the rights of any person. You acknowledge that once information is released to law enforcement, official partners, the public, or recipients you select, it may be copied, redistributed, and retained by them, and that the Company cannot recall, control, or delete information once it has left the App. The Company is not obligated to publish, transmit, or distribute any material and may decline to publish, or may remove, any material at its discretion.

This permission is in addition to, and does not limit, the representations, warranties, and indemnification you make elsewhere in these Terms. To the maximum extent permitted by law, you release the Company and its owners, employees, and suppliers from any claim arising out of the authorized reproduction, publication, distribution, or display of this information, and you remain solely responsible for the accuracy of the information you submit and for your authority to submit and authorize the release of it.

10. Subscriptions, Fees, and Trials

Some features may require a paid subscription. Where subscriptions are offered, pricing, billing frequency, and included features will be presented to you before purchase. Payments are processed by third-party providers (such as Apple, Google, or Stripe), and purchases made through an app store are also subject to that store’s terms. Unless required by law or stated otherwise, fees are non-refundable. Subscriptions renew automatically until canceled through the applicable app store or account settings. We may change pricing or features on reasonable notice.

11. Third-Party Services

The App relies on third-party services — including mapping, messaging, email, hosting, and payment providers — to function. Your use of the App may also be subject to those providers’ terms. We are not responsible for the acts, omissions, availability, or content of third-party services.

12. Intellectual Property

The App, including its software, design, text, graphics, and trademarks (including “Protect Our Family”), is owned by the Company or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal family-safety purposes in accordance with these Terms. You retain ownership of the content you submit and grant us a license to use it solely to operate and provide the App to you.

13. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what information we collect and how we use and protect it. By using the App, you consent to those practices.

14. Disclaimers of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ALERTS, MESSAGES, OR LOCATION DATA WILL BE DELIVERED OR ACCURATE. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, INJURY, OR HARM ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, INCLUDING ANY FAILURE OR DELAY IN DELIVERING ALERTS, MESSAGES, OR LOCATION INFORMATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless the Company and its owners, employees, and suppliers from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your content, your violation of these Terms, or your violation of any law or the rights of another person — including any claim that you tracked or shared information about a person without proper authority or consent.

17. Suspension and Termination

You may stop using the App and delete your account at any time using the in-app account-deletion feature. We may suspend or terminate your access if you violate these Terms, misuse the App, or where necessary to protect users or comply with law. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. Subject to any rights you may have under applicable consumer-protection law, you agree that any dispute will be resolved in the state or federal courts located in Michigan, and you consent to their jurisdiction. Nothing in these Terms limits any non-waivable rights you have under the law of your home jurisdiction.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above and, where appropriate, notify you in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
