Protect Our Family is a family-safety service operated by Protect Our Family Inc. (“Protect Our Family,” “we,” “us,” or “our”), a Michigan corporation. This Anti-Spam Policy explains how we handle electronic messages — email, text/SMS, and push notifications — sent through our website at protectourfamily.net and our mobile application (together, the “Service”), and the standards we and our users are required to follow.

We built Protect Our Family to send the messages that matter most in an emergency — and nothing you did not ask for. We do not sell your data, and we do not send unsolicited bulk marketing. This policy is our commitment to keeping every message you receive from us wanted, expected, and clearly identified.

Life-safety messages come first.

Protect Our Family exists to deliver missing-person alerts, emergency “SOS” notifications, and community safety broadcasts. These are safety-critical, transactional communications — not marketing — and, as explained in Section 6, they are treated differently from promotional messages under this policy and under applicable law.

1.  Our anti-spam commitment

We are committed to responsible messaging. Specifically, we pledge that we will:

·   Permission first — send commercial or promotional messages only to people who have asked to receive them;

·   Transparency — clearly identify who a message is from and why you are receiving it;

·   Easy exit — honor every opt-out or unsubscribe request promptly and completely;

·   Never sold — never sell, rent, or trade your contact information or send you messages on behalf of unrelated third parties;

·   Follow the law — comply with the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), applicable state texting and privacy laws, and — where they apply — Canada’s Anti-Spam Legislation (CASL) and the EU/UK GDPR and ePrivacy rules.

2.  Scope of this policy

This policy applies to all electronic messages we send or that are sent through the Service, across every channel:

·   Email — account, security, billing, and service notices; safety alerts; and any newsletters or product updates you opt into.

·   Text / SMS & MMS — one-time verification codes, emergency and missing-person alerts, community broadcasts, reminders, and — only with your consent — occasional service messages.

·   Push notifications — alerts and reminders delivered to your device, controlled by your in-app and device notification settings.

It also governs how members may use the Service to contact others — for example, adding emergency contacts or triggering community broadcasts (see Section 8). This policy works together with our Privacy Policy and Terms of Service, which describe the full range of data practices for the Service.

3.  What we mean by “spam”

“Spam” means any unsolicited, unwanted, or deceptive electronic message — most often bulk commercial email, text, or messaging — sent to recipients who did not give permission to receive it. We consider a message to be spam if it does any of the following:

·   is sent to someone who never consented to receive that type of message from us;

·   uses false or misleading sender names, “from” addresses, subject lines, or routing information;

·   hides or omits a working way to opt out, or ignores an opt-out request;

·   collects addresses through harvesting, scraping, purchased lists, or dictionary/automated generation;

·   promotes unrelated third-party products or is sent on behalf of parties with no relationship to you.

We do not send spam, and we do not permit our Service to be used to send it.

4.  How we obtain your consent

We only send messages where we have a proper legal basis to do so. Depending on the message type, that basis is:

·   Express opt-in — when you create an account, subscribe to a plan, add a phone number or email, set up emergency contacts, or check a box asking to receive texts or updates. For text messages, we obtain the express consent required by the TCPA before sending, and message-and-data rates may apply.

·   Service relationship — transactional and relationship messages (for example, verification codes, receipts, security notices, and safety alerts tied to your account or household) are sent because they are necessary to provide the Service you signed up for.

We keep records of the consent you provide. We do not buy contact lists, and we do not add anyone to marketing messaging without their permission. You may be asked to confirm your email or phone number before messages begin.

5.  Types of messages we send

We separate the messages we send into three categories, and we treat each differently:

·   Safety-critical alerts — the core purpose of the Service — missing-person alerts, SOS/emergency notifications, community search broadcasts, and related recovery or “all-clear” updates. See Section 6.

·   Transactional & account messages — account verification, login and security notices, subscription and billing confirmations, compliance reminders (such as profile-photo update prompts), and important changes to the Service or its policies. These are not marketing and are sent as long as you have an active account.

·   Promotional messages — newsletters, feature announcements, tips, and offers. We send these only if you have opted in, and you can opt out at any time without affecting the two categories above.

6.  Emergency and safety-critical communications

These are not marketing, and they are not spam.

When you or another member of your household triggers a missing-person report or an SOS, Protect Our Family delivers alerts to the recipients you have designated (such as household members and emergency contacts) and, where enabled, to nearby community members who can help. These messages are safety-critical and time-sensitive. Because they are transactional and emergency communications rather than commercial messages, they are handled under the emergency and transactional provisions of the CAN-SPAM Act and the TCPA, not the marketing rules.

To keep these communications trustworthy and non-abusive:

·   emergency alerts are sent only in response to a genuine safety event initiated by an authorized user;

·   recipients of a specific alert are limited to designated contacts and, where applicable, community members within the alert’s search area;

·   community broadcasts are throttled to a reasonable cadence and stop as soon as the person is recovered or the report is cancelled;

·   community members can control or turn off community alerts in their notification settings, while account-owners will still receive the emergency alerts essential to their own household’s safety.

In a life-threatening emergency you should always call 911 (or your local emergency number). Protect Our Family supplements — but does not replace — official emergency services.

7.  How we prevent spam and abuse

To keep our messaging clean and compliant, we:

·   send through reputable, authenticated providers and use email authentication (SPF, DKIM, and DMARC) so recipients can verify our messages are genuinely from us;

·   include a clear sender identity and, in commercial email, a valid physical postal address and a working unsubscribe link;

·   maintain suppression lists so that once you opt out, you stay opted out;

·   monitor bounce, complaint, and opt-out rates and promptly remove invalid or complaining addresses;

·   limit message frequency and never disguise the nature or origin of a message.

8.  Your responsibilities as a user

Protect Our Family lets you add emergency contacts and, in an emergency, reach other people. You agree to use these features responsibly and lawfully. You must:

·   only add phone numbers and email addresses that belong to people who have agreed to be your emergency or household contacts;

·   use alerts, SOS, and community broadcasts solely for genuine safety purposes — never for jokes, testing on unwilling recipients, harassment, advertising, or bulk unsolicited messaging;

·   keep your contact lists accurate and remove people who ask to be removed;

·   comply with all applicable anti-spam, telemarketing, and privacy laws when you use the Service to contact others.

You may not use the Service to send spam, chain messages, or any content that is unlawful, deceptive, or abusive. Misuse may result in suspension or termination of your account (see Section 11).

9.  No selling of data; limited service providers

We do not sell, rent, or trade your email address, phone number, or other contact information, and we do not send you messages advertising unrelated third parties. We share contact details only with the service providers that help us operate the Service — for example, our email delivery, SMS delivery, geolocation, and cloud-hosting providers — and only so they can send messages and provide services on our behalf under contracts that require them to protect your information. Our Privacy Policy describes these practices in full.

10.  How to opt out or unsubscribe

You are always in control of the messages you receive. You can opt out at any time:

·   Email — click the “unsubscribe” link at the bottom of any promotional email, or reply asking to be removed. Transactional and account emails will continue while your account is active.

·   Text / SMS — reply STOP to any text to stop further texts of that kind; reply HELP for help. Standard carrier message-and-data rates may apply. Stopping texts may limit safety alerts delivered by SMS.

·   Push notifications — manage or turn off alerts in the app’s notification settings or in your device settings at any time.

One important trade-off.

Because Protect Our Family is a safety service, opting out of a channel (for example, stopping all SMS) may prevent you from receiving emergency and missing-person alerts on that channel. We recommend keeping safety alerts enabled on at least one channel. You can still opt out of purely promotional messages while keeping safety alerts on.

We honor opt-out requests promptly — within the timeframes required by law and, for most channels, effectively immediately.

11.  Reporting spam and enforcement

If you receive a message from or through Protect Our Family that you believe is spam, or if you think our Service is being misused to send unwanted messages, please report it to us using the contact details in Section 13. We investigate every report.

We reserve the right to take any action we consider appropriate against spam or messaging abuse, including removing content, throttling or blocking messages, and suspending or terminating accounts that violate this policy or applicable law.

12.  Changes to this policy

We may update this Anti-Spam Policy from time to time to reflect changes in our practices, our Service, or the law. When we do, we will revise the “Effective date” above and, where appropriate, notify you. Your continued use of the Service after an update means you accept the revised policy.
